释义	法律分析: 如果用人单位在哺乳期安排劳动者上夜班的，劳动者能去告。在一年的有效期间内，劳动者可以依法申请仲裁；对仲裁裁决不服的，则可以在十五日的诉讼时效期间内及时向人民法院提起诉讼，从劳动者收到仲裁裁决之日算起。法律依据:《《中华人民共和国劳动法》》第六十三条不得安排女职工在哺乳未满一周岁的婴儿期间从事国家规定的第三级体力劳动强度的劳动和哺乳期禁忌从事的其他劳动，不得安排其延长工作时间和夜班劳动。
