释义	法律分析：网上是不能买香烟的，是违法行为法律依据：《中华人民共和国烟草专卖法》第三十三条无烟草专卖批发企业许可证经营烟草制品批发业务的，由烟草专卖行政主管部门责令关闭或者停止经营烟草制品批发业务，没收违法所得，处以违法批发的烟草制品价值百分之五十以上一倍以下的罚款。《烟草专卖许可证管理办法》第四十四条公民、法人或者其他组织未领取烟草专卖许可证擅自从事烟草专卖品生产经营活动的，烟草专卖行政主管部门应当依法查处。构成犯罪的，依法移送司法机关追究刑事责任。
