释义	法律分析：行政处罚决定没有送达的后果有两种不同情况： 1、如果行政机关作出处罚后不公没有送达处罚决定而且没有通过其他途径告知当事人行政处罚决定内容，则行政行为没有成立。 2、如果行政机关没有送达行政处罚决定，但是却通过其他途径告知了当事人处罚决定及其内容，则此只属于程序瑕疵，不会影响到其效力。法律依据：《中华人民共和国行政处罚法》第四十条行政处罚决定书应当在宣告后当场交付当事人;当事人不在场的，行政机关应当在七日内依照民事诉讼法的有关规定，将行政处罚决定书送达当事人。
