释义	法律分析: 法定节假日上班的工资应不低于平时工资的百分之三百。需要注意的是通常的长假中，并不是所有的假日都是法定节假日，比如国庆节，只有10月1日至3日，这三天是法定的节假日，其余4日，是正常周末调休，这4天，单位不安排补休的，则应当按日工资的200%计算。法律依据: 《中华人民共和国劳动合同法》第三十条用人单位应当按照劳动合同约定和国家规定，向劳动者及时足额支付劳动报酬。用人单位拖欠或者未足额支付劳动报酬的，劳动者可以依法向当地人民法院申请支付令，人民法院应当依法发出支付令。
