释义	临时羁押属于传唤，依法是不计入拘留时间的。拘留的时间，应从被限制人身自由之日起算。如果在被拘留前，传唤时间超过二十四小时，应计入拘留时间进行折抵。法律依据：《中华人民稿枝共和国刑法》第四十四条拘役的刑期，从判决执行之日起计伏弯算;判决执行以前先行羁押的，羁押一日折抵刑期一日。
