释义	法律分析：取保候审期间算刑期吗：按照《刑法》规定，被判处管制、拘役、有期徒刑的，判决执行以前先行羁押的，可折抵相应刑期。但是注意羁押二字，羁押是指关押在拘留场所，并不包括指取保候审，所以取保候审并不能折抵，不算在刑期里面。法律依据：《中华人民共和国刑事诉讼法》第九十六条人民法院、人民检察院和公安机关如果发现对犯罪嫌疑人、被告人采取强制措施不当的，应当及时撤销或者变更。公安机关释放被逮捕的人或者变更逮捕措施的，应当通知原批准的人民检察院。
