释义	法律分析：随着土地使用制度改革的深化，我国土地租赁存在着两种不同的方式。一是国有土地租赁；一是土地使用权出租。国有土地租赁和土地使用权出租都是国有土地有偿使用的方式。法律依据：《中华人民共和国城市房地产管理法》第五十五条房地产所有权人以营利为目的，将划拨土地使用权的地上建筑物出租的，应当将租金中所含土地收益上缴国家。值得注意的是，如果土地使用者无合法原因擅自出租划拨土地使用权，属非法行为。
