释义	对于刑事诉讼而言，因事实不清或证据不足的情况，只能发回重审一次，如果事实依旧不清证据依旧不足的，应当依法作出判决或裁定，但是由于其他原因发回重审的，没有次数限制。对于民事诉讼而言，因事实方面的问题，二审法院只能发回重审一次，二审法院认为事实仍有错误的，应当在查清后改判，但是由于程序问题发回重审的，没有次数限制。
