释义	我国并没有从婚姻罪，只有重婚罪。重婚罪是指有配偶又与他人结婚或者明知他人有配偶而与之结婚的行为。有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。所谓明知他人有配偶而与之结婚的，是指本人虽无配偶，但明知对方有配偶，而故意与之结婚的（包括登记结婚或者事实婚姻）。此种行为是有意破坏他人婚姻的行为。法律依据：《中华人民共和国刑法》第二百五十八条 【重婚罪】有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
