释义	只有欠款本金超过一万元的，经银行催收仍未归还的，才有可能要承担刑事责任的，相关规定如下： 1、如果是银行向法院提起民事诉讼的，则法院应该在受到诉讼材料之日起7日内决定是否受理。 2、如果你欠款金额达1万元的，经银行两次催收后超过3个月仍不归还的，则构成信用卡诈骗罪，应承担刑事责任。在公安机关立案侦查后，一般要经四个月左右的时间，才会由检察院向法院提起公诉。 3、信用卡欠款被判民事了，之后还是没能力偿还，如果本金超过一万元的，银行可以追究刑事责任的。
