喝酒后驾驶电动三轮车，算酒驾。但是根据电动三轮车的性质，可以分为非机动车和机动车，因此构成酒驾的处罚是不同的。
机动车与非机动车的区别：
1、机动车是指以动车装驱动或者牵引，上道路行驶的供人员乘用或者用于运送物品以及进行工程专项作业的轮式车辆；
2、非机动车是指以人力或者畜力驱动，上道路行驶的交通工具，以及虽有动力装置驱动但设计最高时速、空车质量、外形尺寸符合国家标准的残疾人机动轮椅车、电动自行车等交通工具；
3、关于非机动车的范围的划定与机动车的范围最主要的区别就是车辆的驱动来源是人力或畜力，人力驱动是以人身赋予车辆的力来驱动车辆的运行。这些车辆包括自行车、自行三轮车、手推车等；
4、从严格意义上讲，区分机动车与非机动车的标准，是以是否以机械动力作为车辆的驱动车来划分的。

《中华人民共和国道路交通安全法》第九十一条
饮酒后驾驶机动车的，处暂扣一个月以上三个月以下机动车驾驶证，并处二百元以上五百元以下罚款；醉酒后驾驶机动车的，由公安机关交通管理部门约束至酒醒，处十五日以下拘留和暂扣三个月以上六个月以下机动车驾驶证，并处五百元以上二千元以下罚款。饮酒后驾驶营运机动车的，处暂扣三个月机动车驾驶证，并处五百元罚款；醉酒后驾驶营运机动车的，由公安机关交通管理部门约束至酒醒，处十五日以下拘留和暂扣六个月机动车驾驶证，并处二千元罚款。一年内有前两款规定醉酒后驾驶机动车的行为，被处罚两次以上的，吊销机动车驾驶证，五年内不得驾驶营运机动车。
