问题	电动车肇事逃逸应该怎么处罚
释义	根据我国法律的规定，电动车肇事逃逸后，不构成犯罪的，依法对肇事逃逸者处以行政拘留15天、罚款二百元到二千元。当事人逃逸或者故意破坏、伪造现场、毁灭证据，使交通事故责任无法认定的，应当负全部责任。因而，在交通事故中，肇事司机可能无责任或只有部分责任，但如果逃逸，导致交通事故责任无法认定，司机要承担交通事故的全部责任。交通运输肇事后逃逸或者有其他特别恶劣情节的，构成犯罪，要处三年以上七年以下有期徒刑;因逃逸致人死亡的，处七年以上有期徒刑。
