释义	营业执照被吊销的公司能收购吗我国现行法律也并未规定被吊销营业执照的公司不能进行股权变更。根据法无禁止即允许之法理，公司被吊销营业执照后仍可进行股权转让行为，亦有权以自己的名义进行诉讼活动。法律规定我国《公司法》规定，公司被吊销营业执照后，禁止从事一切经营活动。但是相关法律未规定被吊销营业执照的公司不能进行股权变更。并且，股权转让也不属于上述的经营活动。因此，公司被吊销营业执照的事实，不能成为股权转让的法律障碍，当事人以此为由拒绝履行合同义务的，不应予以支持。
