释义	法律分析: 在职职工可以办理营业执照，办理营业执照的当事人应当携带其本人身份证及复印件；经营场所的房屋租赁合同或者房产证及复印件；申请书等材料递交到登记机关，经过审查予以登记的，就会签发营业执照。《中华人民共和国市场主体登记管理条例》第二十一条申请人申请市场主体设立登记，登记机关依法予以登记的，签发营业执照。营业执照签发日期为市场主体的成立日期。法律、行政法规或者国务院决定规定设立市场主体须经批准的，应当在批准文件有效期内向登记机关申请登记。
