释义	法律分析: 抽逃出资的行为是无效的，并且行为人还应当承担相应的法律责任；构成犯罪的，可以被人民法院处五年以下有期徒刑或者拘役，并处或者单处虚假出资金额或者抽逃出资金额百分之二以上百分之十以下罚金。《中华人民共和国公司法》第二百条公司的发起人、股东在公司成立后，抽逃其出资的，由公司登记机关责令改正，处以所抽逃出资金额百分之五以上百分之十五以下的罚款。
