问题	法院是否可以给党员判缓刑
释义	一般是不能的。根据我国《刑法》的有关规定，缓刑是人民法院根据犯罪嫌疑人的罪行、对社会的危害程度及自我的认错态度，给予的暂缓执行刑法的措施。而缓刑期间也是对犯罪嫌疑人的考验期间，在这一期间内，如果犯罪嫌疑人不违法违规，期满后就不追究刑事责任。否则，期满后监内执行。缓刑的考验期间的计算是从法院判决确定之日起，判决之后才具有法律效力。犯人在判决前还处于关押的时间，这一期间不能折算到缓刑的考验期内。不过法院做出判决之后，起码要10天才能生效，才进入到缓刑的考验期。
