合资公司法人代表可以由总经理担任，想要推举总经理为法人代表的话，条件是非常的苛刻的，可以说如果董事会有一个人不认同总经理担任法人代表的话，那么总经理就不能成为法人代表。
法律依据：
《中华人民共和国公司法》 第十三条 公司法定代表人依照公司章程的规定，由董事长、执行董事或者经理担任，并依法登记。公司法定代表人变更，应当办理变更登记。
