| 释义 |
违章停车申请行政复议的方法如下：
1、申请人提出复议申请；
2、复议机关受理申请后，在七天内把复议申请书的副本或者是复印件发给被申请人；
3、被申请人在收到相关资料之后要之在十日内提出书面的答复；
4、复议机关进行审查和调查，并且提出和通过复议意见；
5、复议机关制作复议决定书。
申请行政复议需要什么材料
1、由申请人签字或者盖章的行政复议申请书；
2、申请人身份证或其他有效身份证件的复印件；
3、申请人委托代理人参加行政复议，提供代理人身份证或者其他有效身份证件的复印件；
4、被申请人作出具体行政行为的证明材料，申请人应提交证明具体行政行为存在的有关材料；
5、申请人因不可抗力或者其他正当理由超过法定复议申请期限申请行政复议的，应提交有效的证据；
6、申请人在申请复议时，有其他证据材料的，可一并提供；
7、复议机关认为需要提交的其他材料。
【法律法规】：《中华人民共和国行政复议法》第九条
公民、法人或者其他组织认为具体行政行为侵犯其合法权益的，可以自知道该具体行政行为之日起六十日内提出行政复议申请；但是法律规定的申请期限超过六十日的除外。
因不可抗力或者其他正当理由耽误法定申请期限的，申请期限自障碍消除之日起继续计算。
