上海不按规定停车怎么处罚

法律分析：《上海市道路交通管理条例》规定违反本条例第四十七条规定，现场发现机动车违法临时停车的，公安机关可以口头警告，令其立即驶离，驾驶人不在现场或者虽在现场但拒绝立即驶离，妨碍其他车辆、行人通行的，处二十元以上二百元以下罚款，并可以将该机动车拖移至不妨碍交通的地点或者公安机关指定的地点停放；
法律依据：《上海市道路交通管理条例》 第四十七条 机动车在未设置禁止停车或者禁止长时停车标志、标线的路段临时停车，应当紧靠道路右侧，机动车驾驶人不得离车，上下人员或者装卸物品后立即驶离。
