释义	法律分析：土地承包经营权不能被继承。如果是以家庭为单位承包土地的，承包期内家庭的某个或部分成员死亡的，土地承包经营权消灭，由发包方收回承包地。如果是以其他方式承包的，在承包期内，承包人死亡的，其继承人可以在承包期内继续承包。能够作为遗产被继承的只能是被继承人的合法财产，而对于土地承包经营权并不是财产，而是一种权利。法律依据：《民法典》第一千一百二十二条，遗产是自然人死亡时遗留的个人合法财产。依照法律规定或者根据其性质不得继承的遗产，不得继承。
