释义	法律分析：履约担保是工程发包人为防止承包人在合同执行过程中违反合同规定或违约，并弥补给发包人造成的经济损失。其形式有履约担保金(又叫履约保证金)、履约银行保函和履约担保书三种。履约保证金可用保兑支票、银行汇票或现金支票，履约保证金一般不超过合同价格的10%。法律依据：《中华人民共和国招标投标法实施条例》第五十八条招标文件要求中标人提交履约保证金的，中标人应当按照招标文件的要求提交。履约保证金不得超过中标合同金额的10%。
