释义	法律分析：合同法实施以后成立的合同发生纠纷起诉到人民法院的，适用合同法的规定；合同法实施以前成立的合同发生纠纷起诉到人民法院的，除本解释另有规定的以外，适用当时的法律规定，当时没有法律规定的，可以适用合同法的有关规定。法律依据：《中华人民共和国民法典》第九十七条合同解除后，尚未履行的，终止履行；已经履行的，根据履行情况和合同性质，当事人可以要求恢复原状、采取其他补救措施，并有权要求赔偿损失。
