军事法院不归最高院管。各级法院都是独立的，只是对判决的监督关系。军事法院是设立的负责审判军职工作的组织机构。由庭长一人、副庭长和审判员若干人组成，负责代表军事法院依法审判军职犯罪案件。《最高人民法院关于军事法院管辖民事案件若干问题的规定》第一条
下列民事案件，由军事法院管辖：
（一）双方当事人均为军人或者军队单位的案件，但法律另有规定的除外；
（二）涉及机密级以上军事秘密的案件；
（三）军队设立选举委员会的选民资格案件；
（四）认定营区内无主财产案件。
