罚款扣工资违反劳动法吗

违法，在2008年我国《企业职工奖惩条例》就废止了企业拥有的罚款权这一项，用人单位不能再根据该条例的规定在规章制度中设立罚款条款；同时根据劳动法第九十一条的规定，克扣劳动者工资的，由劳动行政部门责令用人单位支付劳动者的工资报酬、经济补偿，并可以责令支付赔偿金。
