问题	婚姻法离婚上诉程序
释义	当事人不服一审判决的，应当在判决书送达之日起15日内向上一级人民法院提起上诉。上诉应递交上诉状。上诉状应向原审人民法院提出，提交副本一份。原审人民法院收到上诉状，应当在5日内将上诉状副本送达对方当事人，对方当事人在收到之日起15日内提出答辩状，人民法院应当在收到答辩状之日起5日内将副本送达上诉人，对方不答辩的不影响案件的审理。原审人民法院收到上诉状、答辩状，应当在5日内连同全部案卷和证据报送第二审人民法院。
