释义	根据我国法律规章，父母对孩子有抚养义务，因此不抚养孩子是违法行为。如果是已经离婚的，按照双方约定或者法院判决确定，约定或者判决由父亲来抚养的，则母亲不必抚养孩子，但要给予抚养费用。也就是说这种情况下，母亲不抚养孩子不违法。法律依据: 《中华人民共和国未成年人保护法》第十条父母或者其他监护人应当创造良好、和睦的家庭环境，依法履行对未成年人的监护职责和抚养义务。
