释义	所谓贪污罪未遂，是指行为人已经着手实行贪污犯罪，由于犯罪分子意志以外的原因而未得逞。其特征是：1、行为人已着手实施贪污行为；2、行为人还没有取得对公共(国有)财物或非国有单位财物的实际控制权或所有权；3、没有取得对公共(国有)财物或非国有单位财物实际控制权的原因，是由于行为人意志以外的原因。【本文关联的相关法律依据】《中华人民共和国刑法》第二十三条已经着手实行犯罪，由于犯罪分子意志以外的原因而未得逞的，是犯罪未遂。对于未遂犯，可以比照既遂犯从轻或者减轻处罚。
