释义	法律分析：我国刑法规定:从旧兼从轻原则。适用于所有正在审理的案件,但已经生效的判决,则不适用,原判决仍然有效。法律依据：《中华人民共和国刑法》第一百二十八条第一款违反枪支管理规定，非法持有、私藏枪支、弹药的，处三年以下有期徒刑、拘役或者管制；情节严重的，处三年以上七年以下有期徒刑。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
