败诉一般不需承担对方律师费，但是在商标权、著作权等知识产权案件，合同明确约定的案件中，当事人存在明显不当行为，造成诉讼对方或第三人直接损失的，人民法院可以根据具体情况对无过错方依法提出的赔偿合理的律师费用等正当要求予以支持。
法律诉讼流程是怎样的
法院审判流程大致可分为开庭、法庭调查、法庭辩论、被告人最后陈述，评议和审判五个阶段。人民法院审理民事案件，应当在开庭三日前通知当事人和其他诉讼参与人。公开审理的，应当公告当事人姓名、案由和开庭的时间、地点。一审二审都败诉可以向最高人民法院提出终审申诉。根据刑事诉讼法的规定，当事人及其法定代理人、近亲属，对已经发生法律效力的判决、裁定，可以向人民法院或者人民检察院提出申诉，但是不能停止判决、裁定的执行。
综上所述，一般由自己承担，以下案件如果对方败诉的话，是可以要求对方来承担律师费的。

著作权法第四十九条第一款规定的制止侵权行为所支付的合理开支，包括权利人或者委托代理人对侵权行为进行调查、取证的合理费用。
人民法院根据当事人的诉讼请求和具体案情，可以将符合国家有关部门规定的律师费用计算在赔偿范围内。
