释义	法律分析: 民事诉讼如果适用的是简易程序审限为3个月，如果适用的是普通程序审限为6个月。但是这个期限不是绝对不变的，这个期限经过院长审批或上级法院审批是可以延长的，因此民事诉讼审限届满日期到了后开庭合不合法不能一概而论，经过批准的就是合法的，没有经过批准的就是不合法的。法律依据: 《中华人民共和国民事诉讼法》第一百三十六条人民法院审理民事案件，应当在开庭三日前通知当事人和其他诉讼参与人。公开审理的，应当公告当事人姓名、案由和开庭的时间、地点。
