释义	法律分析: 可以的，但必须法官口头裁定撤诉是有效的，一定是原告未到庭，或者原告要求撤诉，否则，没有其他原因裁定撤诉。在法院宣告判决前，自诉人同被告人和解，申请撤回自诉的，在审查没有强迫、威吓等情况后，法院将予以支持。对于自诉人要求撤诉的，经法院审查认为确属自愿的，应当准许；经审查认为自诉人系被强迫、威吓等，不是出于自愿的，应当不予准许。【法律依据】: 《中华人民共和国刑事诉讼法》第一百七十二条人民法院对自诉案件，可以进行调解；自诉人在宣告判决前，可以同被告人自行和解或者撤回自诉。
