法律依据：
1.《中华人民共和国刑法》第383条规定：“国家工作人员利用职权，侵吞、窃取、骗取或者以其他手段非法占有公共财物的，处三年以下有期徒刑或者拘役，并处或者单处罚金。”
2.《中华人民共和国反腐败法》第四十六条规定：“国家工作人员有下列情形之一的，应当依照行政法规规定给予行政处分，并可以依法追究刑事责任：（一）徇私舞弊，滥用职权；（二）利用职权或者职务上的便利为他人谋取利益，或者收受他人给予的财物。”
3.《中华人民共和国公务员法》第四十七条规定：“国家工作人员利用职权或者职务上的便利为本人或者他人谋取利益，情节严重的，应当给予撤职或者开除处分；构成犯罪的，依法追究刑事责任。”
职务犯罪严重损害了国家和人民的利益，应当依法惩处。同时，也应当加强对公职人员的监管和管理，预防职务犯罪的发生。
