释义	我国在认定夫妻共同债务的问题上，采取的是以债务的发生时间为原则、以特殊约定为例外的判断标准，即夫妻关系存续期间，一方以个人名义所负债务，只要不存在债权人与债务人明确约定为个人债务或债权人明知夫妻对婚姻关系存续期间所得的财产约定归各自所有的情形，则一律认定为夫妻共同债务。但夫妻一方在从事赌博、吸毒等违法犯罪活动中所负的债务，不能认定为夫妻共同债务。法律依据《中华人民共和国民法典》第一千零六十四条最高人民法院关于适用《中华人民共和国民法典》婚姻家庭编的解释(一)第三十四条
