释义	法律分析： 1、交定金的，只有收据即可以认定双方的定金合同成立。 2、如交纳定金后，交纳人没有按约定订立合同的，无权要求返还定金。如收款人没有按照约定订立合同的，要双倍返还定金。法律依据：《中华人民共和国民法典》第八十九条当事人可以约定一方向对方给付定金作为债务的担保。债务人履行债务后，定金应抵作价款或者收回。给付定金的一方不履行约定的债务的,无权要求返还定金；收受定金的一方不履行约定的债务的，应双倍返还定金。
