释义	协议离婚的基本步骤是：双方协商后，凭双方的离婚协议书、结婚证、身份证到原婚姻登记机关或任一方户籍所在地的民政部门办理离婚手续，领取离婚证；如果是诉讼离婚，一方可以单方面在被告住所地法院起诉，或者在被告非户口所在地但常居住超过一年以上的所在地法院起诉。【法律依据】《婚姻法》第三十一条，男女双方自愿离婚的，准予离婚。双方必须到婚姻登记机关申请离婚。婚姻登记机关查明双方确实是自愿并对子女和财产问题已有适当处理时，发给离婚证。
