释义	假释期间犯罪不构成累犯。犯罪分子在假释考验期内又犯新罪的，不构成累犯。因为累犯成立的要求是后罪发生的时间，在前罪所判处的刑罚执行完毕或者赦免以后的5年之内。犯罪分子被假释的，假释考验期期满才视为刑罚执行完毕，所以这5年的期限，对于被假释的犯罪人，应从假释期满之日起计算。法律依据《刑法》第六十五条、第六十六条、第八十六条
