释义	法律分析：如果未中标，投标人的投标保证金可以退还。法律依据：《招标投标法实施条例》第五十七条招标人最迟应当在书面合同签订后5日内向中标人和未中标的投标人退还投标保证金及银行同期存款利息。《工程建设项目勘察设计招标投标办法》第四十四条招标人与中标人签订合同后五个工作日内，应当向中标人和未中标人一次性退还投标保证金。招标文件中规定给予未中标人经济补偿的，也应在此期限内一并给付。
