释义	法律主观：代履行是指义务人逾期不履行行政法义务，由他人代为履行可以达到相同目的的，行政机关可以自己代为履行或者委托第三人代为履行，向义务人征收代履行费用的强制执行制度。代履行主要适用于该行政法义务属于可以由他人代替履行的作为义务，例如排除障碍、恢复原状、强制拆除等。对于不能够由他人替代的义务和不作为义务，特别是与人身有关的义务，不能适用代履行。《行政强制法》第51条第2款规定代履行的费用按照成本合理确定，由当事人承担。但是法律另有规定的除外“
