问题	申请劳动能力鉴定的前提有哪些
释义	用人单位、工伤职工或者其直系亲属应当在职工医疗终结期满三十日内向本统筹地区劳动能力鉴定委员会提出申请，并提供工伤认定决定和职工工伤医疗的有关资料。医疗终结期需延长的，由劳动能力鉴定委员会批准。根据《工伤保险条例》第21条和第31条的规定，工伤职工进行劳动能力鉴定应符合以下条件：1、经过治疗后，伤情处于相对稳定状态；2、职工经治疗后，发现确实是因工作原因造成职工身体上的残疾；3、工伤职工的残疾对以后的工作、生活造成了影响。工伤职工符合上述条件，应当进行劳动能力鉴定。
