释义	（一）企业应具备企业法人资格，外贸流通企业成立时间一年以上，经工商行政管理部门登记注册领取《企业法人营业执照》，按国家规定办理工商年检并通过年检。（二）注册资本（金）外贸流通企业不低于300万元人民币；生产企业不低于200万人民币（生产企业可视情况放宽条件）。（三）已办理税务登记，依法纳税，按国家规定办理税务年检并通过年检。（四）该企业法定代表人或负责人，在3年内未曾担任过被撤销对外贸易经营许可的企业的法定代表人或负责人。法律依据关于进出口经营资格管理的有关规定
