集体土地使用证建房算是违建吗 -法律知识

法律分析:
看具体情况来判定：
其一、有土地使用证，但是没有要到当地的建筑管理部门提出申请的，则该房屋是属于违建房；
其二、不符合上述情况的，则不属于违建房。
法律依据:
《中华人民共和国土地管理法》 第九条 城市市区的土地属于国家所有。农村和城市郊区的土地，除由法律规定属于国家所有的以外，属于农民集体所有；宅基地和自留地、自留山，属于农民集体所有。
