被宣告死亡期间子女被收养如何处理
释义
被宣告死亡的人在被宣告死亡期间，其子女被他人依法收养，被宣告死亡的人在死亡宣告被撤销后，仅以未经本人同意而主张收养关系无效的，一般不应准许，但收养人和被收养人同意的除外。
法律依据
《中华人民共和国收养法》
第二十三条自收养关系成立之日起，养父母与养子女间的权利义务关系，适用法律关于父母子女关系的规定;养子女与养父母的近亲属间的权利义务关系，适用法律关于子女与父母的近亲属关系的规定。
