释义	我国《刑事诉讼法》及《监狱法》等都没有明确对判刑后如何分配监狱的规定，在司法实践中，除剩余刑期在三个月以内的由看守所代为执行外，其他罪犯由人民法院送往监狱进行集训，然后由各省监狱管理局根据所辖监狱的押犯情况进行分配法律依据：《中华人民共和国刑事诉讼法》第二百五十三条对被判处死刑缓期二年执行、无期徒刑、有期徒刑的罪犯，由公安机关依法将该罪犯送交监狱执行刑罚。对被判处有期徒刑的罪犯，在被交付执行刑罚前，剩余刑期在三个月以下的，由看守所代为执行。对被判处拘役的罪犯，由公安机关执行。
