释义	法律分析：虽然按照赠与合同的规定，一方做出的赠与没有法定撤销事由是无法追回来的。但是，在没有另外约定财产分配协议中的夫妻财产就不受这个限制。丈夫出轨赠与小三的钱财，可以通过夫妻共同财产单方赠与权利受限来追回。法律依据：《中华人民共和国民法典》第六百六十三条受赠人有下列情形之一的，赠与人可以撤销赠与： (一)严重侵害赠与人或者赠与人近亲属的合法权益； (二)对赠与人有扶养义务而不履行； (三)不履行赠与合同约定的义务。赠与人的撤销权，自知道或者应当知道撤销事由之日起一年内行使。
