释义	小额诉讼可以提起再审，小额诉讼是实行一审终审制的案件。对于不服小额诉讼判决的申请再审适用民事诉讼法199条规定，可以向原审法院的上级法院申请再审，也可以适用司法解释第四百二十六条规定，向原审法院申请再审。法律依据：《中华人民共和国民事诉讼法》第一百九十九条当事人对已经发生法律效力的判决、裁定，认为有错误的，可以向上一级人民法院申请再审;当事人一方人数众多或者当事人双方为公民的案件，也可以向原审人民法院申请再审。当事人申请再审的，不停止判决、裁定的执行。
