46、入职竞业协议有约束力吗
有约束力。如果协议内容没有法律关于无效合同规定的，竞业协议就有约束力。但是，劳动者与用人单位签订竞业限制协议的，用人单位需向劳动者支付竞业限制补偿，否则劳动者可以主张协议无效。
竞业限制补偿金的发放时间由用人单位和劳动者共同协商，并在劳动合同或者竞业限制协议中作出约定。如果未作约定或者未协商的，应当按月支付。另外，如果用人单位超过三个月未支付的，劳动者可以请求法院解除竞业限制协议。
一、哪些劳动者需要签订竞业合同?
根据《劳动合同法》第二十四条，签订竞业合同的劳动者限于以下三种人员：
(一)高级管理人员
一般是指公司经理、副经理、财务负责人、上市公司董事会秘书和公司章程规定的其他人员。
(二)高级技术人员
很容易知道公司商业秘密的高级研究开发人员、技术人员、关键岗位的技术工人等。
(三)其他负有保密义务的人员。
竞业协议在签订时，可以按照法律上规定的程序来进行合法的处理，特别是对于违约金的具体标准是基于双方协商达成一致后认定的，如果合同双方对相关情况的认定有异议的，必须在协商后才可以签订，涉及到强迫签订的合同是无效的。

第八条 当事人在劳动合同或者保密协议中约定了竞业限制和经济补偿，劳动合同解除或者终止后，因用人单位的原因导致三个月未支付经济补偿，劳动者请求解除竞业限制约定的，人民法院应予支持。
