释义	法律分析: 侵害他人人身权益，造成他人严重精神损害的，被侵权人可以请求精神损害赔偿。诽谤，是指故意捏造并散布虚构的事实,贬损他人人格,破坏他人名誉的行为。诽谤他人，必然侵害他人的名誉，因此，根据侵权责任法的规定，侵权人应当承担赔偿精神损失的民事责任。法律依据: 《中华人民共和国刑法》第二百四十六条以暴力或者其他方法公然侮辱他人或者捏造事实诽谤他人，情节严重的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。
