释义	律师解答：在很多的劳动工资的纠纷中，对于单位是否已经支付工资由谁来承担举证责任双方常常会争执不下。但是，根据我国的有关司法解释，是否已经支付工资的举证责任应该由用人单位来承担。【法律依据】：《中华人民共和国劳动法》第三十六条国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。第四十八条国家实行最低工资保障制度。最低工资的具体标准由省、自治区、直辖市人民政府规定，报国务院备案。用人单位支付劳动者的工资不得低于当地最低工资标准。
