释义	根据《工伤保险条例》第六十条的规定，用人单位依照本条例规定应当参加工伤保险而未参加的，由社会保险行政部门责令改正;未参加工伤保险期间用人单位职工发生工伤的，由该用人单位按照本条例规定的工伤保险待遇项目和标准支付费用。用人单位对于参保和未参保职工所负的责任是一样的，只不过责任承担的方式不同，用人单位如果未承担缴纳工伤保险费的责任，就要承担受伤职工工伤待遇的全部责任，同时保证参保和未参保职工在发生工伤时，享有工伤待遇的标准一致。
