释义	法律分析：我国刑法规定并不是故意造成危害结果的行为才算犯罪，有些过失造成了严重危害结果的，也是犯罪。按我国刑法规定，由于责任人的过错，造成他人伤害的，属重大责任事故罪，要判处三年以下有期徒刑或者拘役，所以说，不是有意伤人且造成他人身体严重伤害的，也要判刑。法律依据：《中华人民共和国刑法》第二百三十三条过失致人死亡的，处三年以上七年以下有期徒刑;情节较轻的，处三年以下有期徒刑。本法另有规定的，依照规定。
